Texas Refusal to Grant Divorce Leaves Couple in a Tough Spot! – Blog 108

After three years of marriage, a couple petitioned a Texas family court for a divorce in 2009. For most couples in this position, deciding issues of custody, spousal support and property division are the keys and those who can work out these matters with the help of a divorce attorney at Bertolino LLP can draft a divorce settlement, dissolve their marriages and move on with their lives.

broken-heart-975584-m

This couple, however, was not able to do so. Instead, as Slate reports, their divorce case has now made its way through several lower courts and the Texas Supreme Court will hear arguments on November 5, which will determine whether the couple is able to end their marriage.

Texas Supreme Court Addresses the Issue of Gay Divorce

This divorce has become a major legal battle because the couple is gay. The two men were married in Massachusetts in 2006, where the laws have allowed for same sex marriage since 2004.  The men then moved to Texas, however, where voters approved an amendment to the Texas Constitution and Family Code in 2005 banning same sex marriages and civil unions. Since gay marriage is not recognized in Texas under this amendment, by extension the Texas courts also do not have jurisdiction to grant a same sex divorce.

The men are not able to simply go to Massachusetts to end their marriage, nor can they travel to any other state that recognizes same-sex marriages. The problem is that every state has a residency requirement for divorce, which means that at least one of the spouses has to live in that state for a period of time before the court has jurisdiction to grant a divorce.

Diabetic Test Recall and Warnings of False Claims about Diabetes Drugs

Source

This July, the Food and Drug Administration issued a warning to diabetes patients about diabetes treatments that were being illegally sold. The FDA cautioned that some companies are trying to take advantage of the rising number of patients with diabetes by making false promises. Just a few short days later, on July 31, the FDA released yet another warning to diabetes patients, this time alerting them about a massive recall of diabetes test strips.

Our law firm know that diabetes patients are generally reliant on a variety of different medical products and drugs in order to manage and treat symptoms of their condition. Unfortunately, the reliance on medical products puts diabetes patients at great risk of harm when drug companies and pharmaceutical manufacturers release dangerous or defective products.

FDA Warnings to Diabetes Patients

The first of the FDA warnings released towards the end of July addressed products sold with false claims about their ability to prevent, treat and cure diabetes. The FDA had launched an investigation of diabetes products that were being marketed to consumers with promises that could not be kept, surveying the marketplace to find treatments that were being sold illegally.

The FDA found that there were an abundance of such products and sent 15 different companies warning letters indicating that their sale of diabetes products was violating federal law. The drugs targeted by the FDA included:

  • Products sold as dietary supplements
  • Alternative medicines such as ayurvedics
  • Prescription drugs
  • Over the counter drugs
  • Homeopathic products

SAN ANTONIO Texas News623

Nov

SAN ANTONIO, Texas
– They didn’t get to watch their children grow up into young adults. They missed saying goodbye to grandparents, and in one case, a father, before those loved ones passed away.

But three women who were released from prison on Monday after spending more than a decade behind bars – for crimes they say they didn’t commit – said they relished their new-found freedom and would continue fighting for their full exoneration.

“I got to meet my son for the first time since he was 4,” said Liz Ramirez, 39, who along with the other women spoke with NBC News on Tuesday in their first interview since their release. “It was an amazing feeling, being in his arms.”

What sent the women to prison – Ramirez received a 37.5-year sentence and the others each got 15 years – were allegations of abuse leveled by Ramirez’s two young nieces, then 7 and 9 years old. The girls accused the four friends of sexually assaulting them twice in late July 1994 while they were visiting Ramirez at her apartment.

The women’s lawyer, Michael Ware, said the trial transcripts showed inconsistencies in the testimony given by the girls. But the crucial witness was a doctor who testified that the older girl’s hymen bore a scar that could only have come from abuse around the time of the alleged attacks, Ware said.

“I want to apologize to them. It’s hard,” she said, breaking down into tears. “I’m sorry for everything. I should have just spoken out a long time ago when I was a kid.”

Traffic Accidents in CA – Technology is No Substitute for Attentive Drivers – Article 757

Nov

Any auto accident lawyer in Irvine knows that the majority of car accidents are caused by human error. This has raised an important question: can technology, and ultimately self-driving cars, help to reduce the number of accidents that occur on the roads?  Some predict that it can. And we may not have to wait very long to find out the answer to this question, as the Wall Street Journal is reporting that Nissan pledges to market an affordable “self-driving” car by 2020.

According the Journal article, the executive vice president of Nissan demonstrated how a prototype of one of the self-driving vehicles, the Leaf electric car, could drive itself and respond to various situations on the road. The executive vice president also commented that most of the technology solutions needed for self-driving cars are already available and that the next big hurdle to overcome is the regulatory framework.

Could Self Driving Cars Reduce Accidents?

Part of the demonstration of the prototype vehicle involved showing how a combination of radar sensors, cameras and laser guidance systems could be used to allow the car to drive itself and avoid and interact with various obstacles on a track.

The vehicle was able to slow down and stop at a red light; to swerve to the left in order to avoid colliding with a pedestrian who jumped in front of the car; and to turn right in response to a turn signal, as well as simulate getting off at a freeway exit.

The sensors that allowed the car to do all of these things were built into the body, unlike prototype models currently being produced by Google that have a rotating device on the roof.  While the Nissan technology is still under development, a lot of the technology that will be necessary to make self driving vehicles a common reality already exists.

Maybe you Should Form an S-Corporation to Save on Income Taxes

Should You Form an S-Corporation to Save on Income Taxes?

Source

If you are operating a business, Tummel and Casso should be consulted to help determine the right structure for your entity.  While some operate as sole proprietors and the business thus has no separate legal identity, many entrepreneurs and self-employed individuals can benefit greatly from forming an S-corporation. business-growth-3-1426748-m

An S-corporation allows for small business owners to achieve certain protections from liability and can limit personal responsibility for business debts. Since the business is a separate legal entity, the business is distinct from the individual who owns it.  An S-corporation can also help a small business owner to achieve tax savings.

Is Forming an S-Corporation the Right Step to Take?

S-corporations, unlike C-corporations, allow for pass-through taxation. This means that income and losses from the S-corporation can be claimed on the individual business owner’s tax returns.  An S-corporation thus allows for business owners to avoid the potential double taxation that can go along with forming a C-corp (since the business pays taxes on a C-corp’s profits, and the owners also pay taxes when dividends are issued).

Although income and losses pass through to individual business owners, an s-corporation can still allow for significant tax savings by reducing the amount an individual owner is required to pay in payroll taxes.   Payroll taxes include payments to Medicare and payments to Social Security.  The self-employed pay out 15 percent in payroll taxes since no portion of their taxes are covered by a separate employer as they are for those who earn traditional W-2 wages.

When you form an s-corporation, however, you can pay yourself a salary that is equal to just a portion of the money the S-corporation makes. You can use the remainder of the money to pay out to yourself in periodic distributions.   This allows you to avoid paying payroll taxes on a portion of the money earned that is distributed in distributions.

The Risks of Distracted Driving – Causes of Tennessee Traffic Accidents

Oct
21

Source

Distracted driving has become one of the top causes of auto accidents, with so many people on cell phones today who either talk or send texts behind the wheel.  Using the phone in the car, getting involved in conversations with passengers, eating, grooming and even having a pet in the car with you have all been demonstrated to be risky behaviors that can increase your accident risk.

Now, however, one study suggests that there may be some good news when it comes to distracted driving: listening to music in the car might be OK. In fact, one recent study indicated that listening to music might even improve your reaction time under some circumstances. Our lawyers know that every driver is different in terms of what takes his focus off the roads. Still, the new study suggests that you might be safe to at least listen to your favorite tunes while you travel.

Music May Not be a Dangerous Distraction

The new study that assessed the impact of music on driving ability was conducted by Dutch researchers and reported on by US News & World Report.  The study involved 47 students between the ages of 19 and 25. The students in the study had, on average, more than two-and-a-half years of driving experience.
The study participants were asked to create a playlist to listen to while they drove. The playlist was supposed to contain music that the drivers were familiar with and that they enjoyed listening to. The drivers then completed a simulated driving course several times while they were listening to the music at various volumes. They took the course with the music off, with the music at intermediate volumes, and with the music turned up loud. The drivers were not able to adjust the volume of the music as they were driving the course, which took about half an hour to complete.  The simulated driving experience mimicked normal driving on a road with two-way traffic, much like the type of driving people might do on their way to work.
The participants were closely monitored as they drove the course and questioned about their experiences. The outcome of the study showed that the music did not have an adverse impact on their ability to drive or focus. In fact, the opposite may have been true. Drivers who had the music on were faster at responding to what the car in front was doing than drivers who did not have the music playing.
